By accessing our website, requesting a quote, or placing an order, you agree to be bound by these Terms. If you do not agree to all terms and conditions, please discontinue use of this website and our services.

2. Custom Orders, Proofs & Approvals

Due to the customized nature of memorials, headstones, markers, and monuments:

  • Design Proofs: A final design proof, sketch, or mock-up will be provided before engraving or fabrication begins. You are solely responsible for reviewing and verifying all details, including spelling, names, dates, artwork, lettering style, and dimensions.
  • Final Approval: Fabrication will only proceed upon receipt of your written or electronic approval. Des Moines Monuments is not liable for typographical errors or layout omissions present in customer-approved proofs.
  • Variations in Natural Stone: Granite, marble, bronze, and other natural stones feature natural variations in color, grain, texture, veining, and pattern. These organic characteristics are inherent to natural stone products and are not considered manufacturing defects.

3. Cemetery Regulations & Permits

Every cemetery maintains its own independent rules, restrictions, sizing guidelines, permit requirements, and foundation fees.

  • The customer is responsible for ensuring that the selected monument design, size, and material comply with the guidelines of the intended cemetery.
  • Cemetery permit fees, foundation setting fees, and grave-opening costs imposed directly by the cemetery or municipality are the financial responsibility of the purchaser unless explicitly itemized and included in our written contract.

4. Pricing, Estimates & Payments

All prices quoted on the website or via estimates are in U.S. Dollars (USD) and are subject to change without prior notice. Estimates provided online or over the phone are valid for 30 days unless otherwise specified.

Custom orders typically require a non-refundable deposit before materials are ordered and production begins. Full payment must be settled in accordance with the terms outlined in your signed purchase agreement prior to delivery, setting, or installation.

5. Production Timelines & Delivery

Monument manufacturing, engraving, and setting timelines are estimates and cannot be guaranteed. Lead times depend on stone quarry availability, custom carving requirements, cemetery foundation schedules, and regional weather conditions (such as winter freezes or ground saturation in Iowa). Des Moines Monuments will make every reasonable effort to keep you informed of your project status.

6. Cancellations & Returns

Because monuments and headstones are custom-ordered and permanently personalized for each family:

  • Once stone cutting, custom procurement, or engraving has commenced following your proof approval, orders cannot be canceled, returned, or refunded.
  • In the event a cancellation request is made prior to the start of stone cutting or carving, any refund will be minus expenses already incurred for design drafting, administrative labor, and non-refundable material deposits.

7. Intellectual Property

All content published on this website—including company logos, images, text, design catalogs, and layouts—is the intellectual property of Des Moines Monuments or its licensed suppliers and is protected under applicable copyright and trademark laws. You may not copy, reproduce, distribute, or create derivative works without prior written consent.

8. User Conduct & Website Use

You agree to use this website only for legitimate purposes. You must not submit false or fraudulent inquiries, upload malicious code, attempt unauthorized access to our web servers, or use our contact channels for spamming purposes.

9. Limitation of Liability

To the fullest extent permitted by law, Des Moines Monuments, its owners, and employees shall not be liable for any indirect, incidental, punitive, or consequential damages resulting from your use of this site or delays in delivery caused by acts of God, quarry delays, inclement weather, cemetery delays, or carrier strikes. Our total liability for any claim arising from an order shall not exceed the amount actually paid by you for that specific order.

10. Governing Law

These Terms and Conditions and any disputes arising under or related to your transactions with us shall be governed by and construed in accordance with the laws of the State of Iowa, United States, without regard to conflict of law principles. Any legal action shall be brought exclusively in the state or federal courts located in Polk County, Iowa.

11. Changes to These Terms

We reserve the right to revise or update these Terms and Conditions at any time without prior notice. Any modifications become effective immediately upon posting to this website. Your continued use of the site after changes are posted constitutes acceptance of the modified Terms.
